1. Acceptance of Terms

Welcome to wunshot PRD Generator. By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our service.

These Terms constitute a legally binding agreement between you and wunshot PRD Generator ("we," "us," or "our").

2. Description of Service

wunshot PRD Generator is an AI-powered service that helps users create Product Requirements Documents (PRDs). Our service includes:

• AI-powered PRD generation using OpenAI GPT-4o
• Multiple subscription tiers with varying usage limits
• Team collaboration and invitation features
• PRD storage and management
• Export functionality

3. User Accounts

3.1 Account Creation

To use our service, you must create an account by signing in with Google OAuth. You agree to:

• Provide accurate and complete information
• Maintain the security of your account
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized access

3.2 Account Eligibility

You must be at least 13 years old to use our service. By using our service, you represent that you meet this requirement.

4. Subscription Plans and Billing

4.1 Subscription Tiers

We offer the following subscription tiers:

• Free: 5 PRDs per month
• Creator: 30 PRDs per month ($9.99 CAD/month)
• Builder: 100 PRDs per month ($19.99 CAD/month)
• Agency: 500 PRDs per month ($59.99 CAD/month)
• Lifetime: 100 PRDs per month (one-time $49.99 CAD)

4.2 Payment

Payments are processed through Stripe. By subscribing to a paid plan, you agree to:

• Pay all fees associated with your chosen plan
• Provide accurate billing information
• Monthly subscriptions automatically renew unless canceled
• All fees are non-refundable except as required by law

4.3 Usage Limits

Each tier has a monthly limit on PRD generation. Limits reset every 30 days from your subscription start date. Unused PRDs do not roll over to the next month.

4.4 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access until the end of your current billing period, after which your account will revert to the Free tier.

5. Acceptable Use

You agree NOT to:

• Use the service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Infringe on intellectual property rights of others
• Transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Use automated systems (bots, scrapers) without permission
• Share your account credentials with others
• Generate content that is harmful, offensive, or illegal
• Abuse the service or circumvent usage limits

6. Intellectual Property

6.1 Your Content

You retain all rights to the prompts you provide and the PRDs generated. By using our service, you grant us a limited license to:

• Process your prompts to generate PRDs
• Store your PRDs in our database
• Use anonymized data to improve our service

6.2 Our Content

All service features, design, text, graphics, and other materials (excluding user-generated content) are owned by us and protected by copyright, trademark, and other laws. You may not copy, modify, or distribute our content without permission.

7. AI-Generated Content

Our service uses OpenAI GPT-4o to generate PRD content. Please note:

• AI-generated content may contain errors or inaccuracies
• You are responsible for reviewing and verifying all generated content
• We do not guarantee the accuracy, completeness, or suitability of generated content
• Generated content should not be used as legal, financial, or professional advice
• You should always review and edit AI-generated content before use

8. Disclaimers and Limitations of Liability

8.1 Service Provided "As Is"

Our service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure.

8.2 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from your use of the service, violation of these Terms, or infringement of any rights of another party.

10. Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the service
• Non-payment of fees
• Any other reason at our discretion

Upon termination, you will lose access to your account and all stored PRDs. You may request a copy of your data before termination by contacting us.

11. Privacy

Your use of the service is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Continued use of the service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Canada.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of our service and supersede any prior agreements.
